COMPULSORY REGULATIONS
FOR ILLICHIVS'KYI SEA COMMERCIAL PORT
1. GENERAL PROVISIONS
1.1. Compulsory Regulations (hereinafter "CR")
for Illichivsk sea commercial port have been issued in accordance with Article
78 of the Code of Merchant Shipping of Ukraine.
1.2.The CR are applicable to the vessels flying all flags
and subject to all authorities staying within the port as well as to organizations,
enterprises, institutions and persons that pursue their activities within
the territory and port water area of the port. References to ignorance of
provisions of the General Rules and CR does not discharge from liability
for their violation. In case of differences between the General Rules and
these CR, the provisions of the latter prevail.
1.3. These CR become effective as of 1 December 1999 and
since that time the CR issued in 1989 become null and void.
1.4. Masters of Ukrainian vessels arriving to the port
may obtain these CR from a pilot or the Port authorities, and the Masters
of foreign vessels - from a pilot or an agent.
1.5. Territory of the Illichivsk Sea Commercial Port (ISCP)
extends in a strip - from the entrance inwards, along the coast of Sukhyi
Firth - to the Second basin and up to the Ferry terminal. This strip of
the territory, i.e. the distance from the shore line to the fence varies
in width from 200 to 1,400 meters.
The area occupied by the Illichivsk Ship Repairing Yard (ISRY), Illichivsk
Sea Fishing Port (ISFP) and the Joint-Stock Company "Antarctica"
are excluded from the specified territory.
1.6. The port water area of the Illichivsk Port includes
water areas of three basins of Sukhyi Firth, the outer roads limited from
the west by a coastal line extended from Velykyi Fontan cape westward up
to Sanzheis'kyi lighthouse, and restricted from the north and south with
the arch of the circle with radius of 4.5 miles from the point: 46°19.1
N; 30°40.8 E (see Annex No. 4). Anchorage No. 351 is also included in the
port waters as a part of the outer roads.
The part of the First basin water area between the port Illichivsk leading
line, the southwest coast and the Pivdenna sand spit makes the inner roads
of the Port.
1.7. The ISFP is located on the north-eastern coast of
the First basin and includes the water area:
- on the south-west: between the Illichivsk Port leading line and the
First leading line of the Second basin of Sukhyi Firth;
- on the south-west: between the Illichivsk Port leading line and the
First leading line of the Second basin of Sukhyi Firth;
- on the north: the line perpendicular to the First leading line of
the Second basin drawn at a distance of 250 m northwards from the beam
of the east light beacon on Dambovyi island.
1.8. The Second basin includes the following water area:
- Illichivsk Ship Repairing Yard (ISRY);
- Technical division of the Sea Waterways Administration;
- Odessa group of "SATKO";
- Technical division of the PJSC "Chornomortechflot";
- Black Sea Geodetic Expedition;
- Maintenance Centre of JSC "Antarctica" fleet.
Each
of the listed companies bears responsibility for a safe stay of vessels
and adherence to the environmental protection requirements.
1.9. The Illichivsk Ferro-Concrete Plant is located on the western coast
of the Third basin and controls and is responsible for a 100 m wide water
from the shoreline seaward.
1.10.
The declared draught in the Port is 12 m. The sailing draught to berths
is declared by the Harbour Master and navigators and other persons concerned
are notified accordingly. In each particular, depending on the expected
cargo-handling operations (discharging/loading), the pilot, together with
Inspection of State Port Supervision (ISPS), decides whether it is possible
to moor a vessel with due consideration of the sailing draught and low/high
level of wind tide in the Port. In case of a disagreement, the sailing
draught value is to be established by the Harbour Master.
1.11.
The ISPS checks if of all vessels coming into the Port comply with the
safety navigation requirements.
Vessels that operate within the Port water area limits are obliged to
submit to the ISPS ship documents, diplomas, fire protection certificate,
permit of sanitary and quarantine authorities, the latest certificate
of vessel's inspection by the ISPS and crew lists certified by the Personnel
division of the shipowner within the period from the 1st to 10th day of
each month. Such vessels are checked by the ISPS on a quarterly basis
if there are no sufficient reasons for extraordinary checking.
1.12. Radar traffic control station (TCS) of the Vessel Traffic Control
System (VTCS) of the Illichivsk Port monitors and controls all vessels
and floating craft sailing in the Port waters. The TCS charges for all
its services in accordance with the established rates.
2. ENTRY OF VESSELS TO THE PORT AND DEPARTURE FROM
THE PORT
2.1. ARRIVAL OF VESSELS TO PORT
Registration of arrival
2.1.1.
Entry to the Port is allowed round-the-clock.
2.1.2. Arrival of vessels is registered in the office
of the Inspection for Port Supervision located on berth No.11 (tel: 16-68;
17-38; 12th channel VHF, call-sign "Illichivsk-radio 5"). Arrival
of vessels anchored in the outer roads anchorage No.351 is not registered.
Log-books, engine-room log and other logs, log-book Registers, are certified
by the ISPS captain-on-duty, he also issues the statements to lodge sea
protests.
2.1.3.
Arrivals of auxiliary craft, port craft and vessels of other shipowners
as well as of coastal passenger boats sailing between Odessa and Yuzhny
ports can be registered at departures; the right of multiple sailings
(following the shipowner's application) can be granted depending on the
validity period of sanitary and fire certificates, but not longer than
for 30 days.
2.2. DEPARTURE OF VESSELS FROM THE PORT
Preparation for departure
2.2.1.
Departure of vessels from the Port is carried out round-the-clock.
2.2.2. The ISPS captain-on-duty checks readiness of
a vessel for departure to sea (for voyage), as a rule, 3-4 days before
the departure, as agreed with administration of a vessel. The registration
report is made in duplicate by the results of the check and one copy is
handed in to the Master of a vessel.
2.2.3. Vessels of the Port fleet leaving for the ports
of Odessa, Ochakiv, Dnipro-Buhskyi, Mykolaiv, Kherson, Skadovsk, Bilhorod
- Dnistrovskyi and Izmail present crew lists certified by the Master.
The port fleet vessels sailing abroad present crew lists signed by the
Master and certified by the Port Manager.
Registration of arrivals of ferry boats sailing on the line Illichivsk
- Varna, "ro-ro" ships and ferries on the line Illichivsk-Poti
can be combined with the registration of departures and carried out on
board departing vessel by the ISPS captain-on-duty.
2.2.4. If a vessel's departure is delayed by 30 minutes
after the time specified in the application for departure, the pilot and
tugs allocated to support the departure can be recalled. In this instance,
the relevant application should be presented again. It is also necessary
to pay the pilotage and towing charges according to the tariff (for a
false call).
2.2.5. The permit for departure of a repaired vessel
after docking at the ISRY can be issued in 6 hours after launching.
2.2.6. No vessel has the right to leave the Port without
registration of the departure by the Port Supervision Authority.
Registration of departure
2.2.7. Departure of a vessel moored at berths and in the
inner roads is registered by the application of the ship's administration.
Departure of a Ukrainian vessel is registered with the ISPS (berth No. 11)
by a representative of the ship administration. Departure of a foreign vessel
is registered by supervisors of agency companies.
By application of a vessel, departure can be registered on board by a representative
of the Port Supervision Authority.
2.2.8. . To register the departure, the Masters of these
vessels should submit to ISPS the following documents:
- diplomas and certificates of crew;
- permit of sanitary and quarantine services;
- fire certificate;
- data on the actual metacentric height (stability information);
- ship documents (including documents of the Register);
- crew list stamped by the Customs in duplicate.
- certificate entitling to navigate independently in Port waters issued
by the Harbour Master (if available).
2.2.9.
Departures of auxiliary vessels, small port craft and vessels of other
shipowners as well as passenger coastal boats sailing between ports Illichivsk,
Odessa and Yuzhny are registered with the ISPS.
Registration of departure of coastal vessels is made according to "Instructions
on the procedure for registration of crew lists and sailing of crew and
members of their families on a coastal voyage".
2.2.10. If a vessel has registered her arrival but proceeded
to the outer roads and has to leave for one of the listed ports: Odessa,
Yuzhnyi, Ochakiv, Dnipro-Buhskyi, Mykolaiv, Kherson, Skadovsk or Bilhorod
-Dnistrovskyi, but can not register the departure according to the established
procedure because of hydrometeorological situation, she may do it, by
way of exception, by radio through the ISPS.
The agent informs ISPS about the numbers and dates of permits issued by
the Customs, Armed Guard Service and Sanitary & Quarantine Service
of the Port, the number of crew on board, its structure, conformity of
the officers' diplomas, quantity and kind of cargo, draught and metacentric
height, validity period of the Register documents, seaworthy condition
of the vessel and all other necessary information.
After registration of the vessel's departure, the Master informs the VTCS
station by radio or telephone that the departure has been registered by
radio.
A vessel, that has registered her arrival and was taken in the outer roads
without registering the departure but intends to sail abroad under unfavourable
hydrometeorological situation, is towed in the inner roads of the Port
to register the departure. All expenses in connection with this operation
(VTCS tracking, pilotage, towage) are charged to the vessel's account.
2.2.11. Masters of vessels arriving to the Port for
loading any cargoes or for partial loading / discharging of grain, loose
and bulk cargoes must, before beginning of cargo operations, submit to
Port Supervision Service the Declaration on transportation properties
of cargoes, the cargo plan (by termination of loading or partial discharging
of a vessel) which corresponds to one of variants of loading in accordance
with the Master's information about stability of the vessel when carrying
grain or bulk cargoes. The information about the vessel's stability should
be certified (signature and seal) by the Register or a foreign classification
society.
The Declaration of transportation properties of cargo (and, in case of
loading cargoes referred to the category of dangerous, also the Certificate
of cargo condition at loading) is prepared and handed to the Master of
the vessel by one of competent organizations recognized by the State Administration
of Maritime and Inland Water Transport of Ukraine.
If a vessel carrying grain and/or loose and bulk cargoes has no information
about stability or if such information has not been certified by the appropriate
classification society, its departure may be permitted after drawing up
the cargo plan together with the Register that should make an appropriate
comments on it.
Vessel's departure or its entry in the roads is registered only after
a representative of the Port Supervision Service checks conformity of
the actual loading (partial discharging of a vessel) with the earlier
submitted cargo plan.
2.2.12. Before a vessel sails to sea, her administration
has to submit to the ISPS the calculation of vessel's stability and the
static stability diagram showing the corrected and permitted metacentric
heights.
2.2.13. Masters of vessels flying the flag of Ukraine
which go to foreign navigation and Masters of foreign vessels report to
the ISPS, through agency companies, on readiness of their vessels for
departure not less than 2 hours before the Border and Customs control
start working onboard.
2.2.14. Dispatching of technical and auxiliary port
fleet vessels to all ships with "closed border" is possible
only after they are inspected by the crew and the obligatory report to
the Border Guard Point officer on duty is made.
Dispatching of "SATKO" vessels to ships for carrying out emergency
operations, including vessels with "closed border", is allowed
by the Dispatching Service with the obligatory notification of the Border
Guard Point about the departure time, the purpose and number of persons
on board. The crew list is prepared and inspection of the vessels by crew
is made while the vessel proceeds for emergency operations.
2.2.15. The services rendered by the ISPS in connection with registration
of arrivals and departures of vessels and checks of their conformity to
International Conventions are paid according to the effective Port rate.
2.3. GENERAL PROCEDURE OF ENTRY AND DEPARTURE
OF VESSELS TO/FROM THE PORT
Pilotage
2.3.1. Masters of all vessels navigating in the Port waters
must strictly fulfil the requirements of these Compulsory Regulations and
Rules of navigation within the area of responsibility of Illichivsk Port.
2.3.2. Pilotage of all vessels of 500 nrt and more is
obligatory. Entry in the Port, departure from the Port and shifting inside
the Port is carried out round-the-clock if piloted by the pilot only.
Excepted are the vessels (including non-self-propelled vessels of less that
500 reg. ton, port fleet vessels, etc.) which Masters have the permit of
the Harbour Master for the right of a non-piloted navigation, and Navy vessels
and ships of the Border Forces of Ukraine.
Pilotage from pilot boarding buoy up to limit of the internal port water
area is considered to be out-of-port.
Pilotage in the internal port water area is considered to be in-port.
2.3.3.The Port receives vessels with a draught up to 12.
0 m. For entry of vessels with the greater draught, the permit of the Harbour
Master of the commercial Port is needed.
Passage from the First basin to the Second basin and vice versa is allowed
to vessels with a draught not exceeding 9.5 m.
The vessel proceeding to the Illichivsk Ship Repairing Yard, Illichivsk
Sea Fishing Port or to the other departmental berths should previously co-ordinate
the sailing draught with administrations of these berths and inform the
ISCP pilot who has been called for pilotage.
2.3.4.Vessels proceeding to the Port or anchored in the
outer roads submit the application for the Port pilot through the TCS (call-sign:
"port - control" on channel 12). The Master's application for
a pilot means the consent to accept the services of pilotage and of the
VTCS.
2.3.5. The Master of a vessel (agent) orders a pilot and
tugs (for shifting or departure of a vessel to sea) after registration of
the departure with the ISPS via the Pilot Service operator 30 minutes before
the vessels is completely ready for mooring ("ILLICHIVSK-RADIO-29"
channel 73, tel. 18-32).
2.3.6.The vessels proceeding from the sea into Sukhyi
Firth meet the pilot at the reception buoy at the point ranging 103° within
1.86 miles from Illichivsk Lighthouse.
In unfavorable hydrometeorological conditions, the place where a pilot boards
or leaves the vessel may be changed as agreed between the Master of the
vessel and the pilot. In storm and icing conditions the pilot can be delivered
and taken off a vessel by port tugs at the shipowner's expense.
2.3.7. Vessels are provided with pilots according to the
order of submitted requests.
2.3.8.Masters of vessels regularly calling at Illichivsk
Port may be permitted to enter and leave the Port independently by the Harbour
Master, however the right of independent navigation within port waters does
not relieve vessels from paying the pilotage dues.
2.3.9. To obtain the right of independent navigation
in port waters, the navigators (Masters, chief mates, and navigators) of
auxiliary vessels, small craft and port fleet passenger boats are obliged
to submit to the Harbour Master the Protocol of annual knowledge test of
COLREG-72, Compulsory regulations, Rules of navigation area and navigational
aids, and the vessel technical data test.
In case of rough infringements of COLREG-72, General Rules and these CR,
a navigator can be deprived of his right of independent navigation in Port
waters.
2.3.10. If the navigational, meteohydrographical situation
in Port waters change, Masters of all vessels, except for passenger boats,
hydrofoil vessels and small craft, are obliged to take a pilot on board
as instructed by the VTCS pilot operator.
2.3.11. All operations with vessels (entering/leaving
docks, shifting, pulling alongside) in the departmental water areas (ISRY,
ISFP, Chornomortechflot, Odesa "SATKO"group, Chornomorsk geodetic
expedition, technical division of Sea Waterways Administration and the Maintenance
Centre of "Antarctica" fleet) are carried out by departmental
pilots.
Departmental pilots have no right to pilot vessels in the water area of
Illichivsk Sea Commercial Port.
2.3.12. A pilot of Illichivsk sea commercial port does
the following:
- passes a vessel proceeding to ISRY to the yard's pilot in the Second
basin of Sukhyi Firth near buoy No.16;
- receives a vessel leaving ISRY at the same buoy;
- passes a vessel proceeding to ISFP in the First basin on the border
of ISCP water area (buoy No.8) to the ISFP pilot;
- receives a vessel - on the border of the ISCP water area;
- passes a vessel proceeding to berth of the other departments on the
border of their water areas to the departmental pilot;
- receives a vessel on same border.
Under unfavorable hydrometeorological conditions both pilots (ISCP and departmental)
should be delivered on boar vessel, thus each pilot bears responsibility
for pilotage separately, when piloting in the water area of his own department.
2.3.13. Mooring vessels, which main engine, steering or
anchor arrangements are out of order, is possible with the permit of the
Harbour Master only. In this case the services of the pilot and linesmen
are paid double. If the wind speed is 10 m/s or higher, the mooring of such
vessels is forbidden.
2.3.14. Pilotage and mooring operations at wind speed
exceeding 14 m/s are prohibited.
2.3.15. If a pilot has been delayed on board without serious
reasons by a fault of the vessel for more than two hours, a separate pilotage
bill is issued and paid for at the pilotage rate.
2.3.16. Piloting of vessels into the Port at low visibility
is to be agreed with the Harbour Master of the Illichivsk Sea Commercial
Port.
3. NAVIGATION OF VESSELS IN PORT WATERS
3.1.NAVIGATION CONDITIONS
General provisions
3.1.1. The Vessel Traffic Control (VTCS) of the Port provides
for safe navigation in the Traffic Separation System of the North-Western
area of the Black Sea, and traffic control in the Port, port waters and
approaches to them (see Annex No. 2 "VTCS Station Ranges").
3.1.2. The VTCS provides the concerned divisions of the
Port with current information about positions of vessels, approach time
and all actions by their request. Other organizations (including agency
companies) may receive this information on a contractual basis or for remuneration
according to the established rate.
3.1.3. Movement of vessels in port waters is carried out
only with the TCS permission (call-sign: "Port-control" channel
12 VHF). The permit is valid during 30 minutes. If the vessel has not started
her movement within 30 minutes, the permit is automatically cancelled and
should be requested anew.
3.1.4. When navigating in water areas of all three basins
of Sukhyi Firth, light vessels should have enough ballast for safe manoeuvring
in the Port and the channel. Ballast amount should be such that the screw
hub is sunk in water while the bow draught is still positive.
The vessels of 20 grt and more should not move with the speed exceeding
5 knots.
The speed of vessels proceeding in the entrance channel should not exceed
6 knots. Acceleration of speed is allowed to prevent emergency situations
only which must be obligatory reported to the TCS operator.
3.1.5. Hydrofoil vessels should proceed in the entrance
channel and port water area in displaced condition.
3.1.6. Vessels of technical, auxiliary and port fleet,
boats and yachts should choose safe routes and give the way to transport
vessels (see Annex No. 5 "Diagram of Safe Routes").
3.1.7. Vessels not equipped with VHF radio stations that
ensure communication with the TCS can not navigate in port waters at visibility
less than 500 m.
3.1.8. Near Dambovyi island, transport vessels may proceed
from the First basin to the Second basin and back by the Eastern passage.
The Western passage is used for auxiliary and port fleet vessels.
3.1.9. A Shipowner (Master) whose vessel intends to follow
to the Third basin should agree the time of swinging the pontoon bridge
with the Port fleet dispatcher 12 hours in advance.
3.1.10. Navigation of sailing ships, motorized recreation
and sport ships and boats in the First and Second basins of the Firth (port
waters) is allowed within a 50 m wide strip from the shoreline along the
northern and eastern coasts. In doing so, it is forbidden:
- to sail where the vessels are anchored, berthed or move;
- to approach the Commercial Port berths and, also, the coastline and
berths of the other companies located in the territory of all Firth's
basins;
- to navigate under sails in the entrance channel and in the water area
of the First and Second basins of the Firth.
3.1.11. Ferries have the priority passage right from the
limits of the traffic control zone up to the berth (or back). Their traffic
is monitored and controlled by the VTCS (TCS), irrespective of the presence
of the Port pilot on board. This service is paid according to the Port rate.
In extreme conditions (poor visibility, ice on water area, wind speed exceeding
10 m/s, presence of vessels in the inner anchorages) the Master of the ferry
must take the pilot on board, even if the permit to sail in Port waters
without a pilot has been issued.
3.1.12. The vessels proceeding to berths may not keep
anchors not heaved up into the hawse-holes, however, the anchors should
be ready for immediate dropping in case of emergency.
3.1.13. All vessels under way are forbidden to keep derricks,
cranes, smart gangways, boats and other objects stretched outboard before
anchoring (except for pilot ladder), this restriction extends, as well,
to the seaward side of the moored vessels.
3.1.14. A vessel carrying explosive and flammable cargoes
are obliged to anchor in anchorage No.351 to wait for the orders of the
Port Authorities and the Fire Service.
The above mentioned vessels, when staying in Port waters, are obliged to
raise to a conspicuous place: in day time - flag "BRAVO" according
to the International Code of Signals; at night - a red light visible around
all quarters (at least 3 mile visibility range).
3.1.15. When moving in the entrance channel, it is forbidden
to drop anchors and drag them between piers which form the Port gate.
3.1.16. When manoeuvring in port waters, it is forbidden
to cross the Illichivsk entrance alignment in the area between the approaching
buoy and the channel entrance.
3.1.17. In port waters it is forbidden to use audible
and visual signals which are not stipulated in the COLREG-72, General Rules
and these Compulsory Regulations.
3.1.18. Only experienced helmsmen may be allowed to steer
when navigating in Port waters. It is forbidden to change the helmsman when
passing areas requiring extra care in ship steering.
3.1.19. To obtain a permit for placement and working
of dredgers in port waters, the Master - dredge master submits 3-copies
of placement diagrams and dredger work areas as well as the dump barges
routes to dumping sites. Such diagrams are to be co-ordinated with the ISPS
and approved by the Harbour Master.
3.1.20. Floating cranes and other vessels executing complicated
and dangerous works with high-tonnage vessels at berths or in the roads
fly in day time two flags R (ROMEO) and Y (UNIFORM) according to the ICS,
and at night - red and green lights one above another that are visible around
all quarters. A passing-by vessel should move at the minimum speed.
3.1.21. When an anchor or other objects that present danger
to navigation are lost or found in Port waters, the Master of the vessel
must immediately inform the Harbour Master.
3.1.22. All vessels are forbidden to make soundings when
proceeding in channels and passages to the Port, moving in Port waters and
lying at the Port berths.
3.1.23. Vessels with the draught of 11.8 m and over, when
staying in port waters, are considered as having limited draught and must
exhibit lights and colours prescribed in Rule 28 COLREG-72.
Note: the requirement of item 3.1.4 does not extend on tugs and fireboats
proceeding to execute special tasks, their speed, however, must ensure safety
of berthed vessels and vessels moored sidewise.
Traffic control
3.1.24. Traffic of all vessels in Port waters is controlled
by the Traffic Control Station of the VTCS system located on the Northern
spit at the root of the northern protecting mole (see Annex No.1).
3.1.25.The TCS pilot operator makes use of the high-resolution
coastal radar and provides for:
- pilotage of vessels from the control zone borders to Port berths of
the First and Second basins of Sukhyi Firth;
- pilotage of vessels from the control zone borders to anchorage No.351;
- pilotage of vessels from the control zone borders to anchorage .No.351
or out of the control zone limits;
- rendering assistance to vessels within control zone in positioning,
assessing the situations and divergence with other vessels.
3.1.26.The VTCS range covers the water area limited by
the arch of a 16 mile radius circle from 46° 19.1 N, 30°40.8 E (TCS building)
and the shoreline.
The specified operation range is the VTCS control zone that makes a part
of the control zone in Port waters that is controlled by is the TCS.
In its zone the VTCS executes functions, has the rights and duties regulated
by these CR and VTCS Provisions (Order of Ukrmorflot No.8 of 08.05.92).
3.1.27. Irrespective of visibility, the VTCS (TCS) functions and provides
service round-the-clock which is to be paid according to the established
procedure, at fixed rates, based on bills issued by the pilot-operator.
All vessels following in the control zone are obliged to use the VTCS (TCS)
services. Master's report on entering the VTCS control zone means the consent
to accept the VTCS (TCS) services and pay for them.
Navy ships and vessels are served free-of-charge.
3.1.28. Radar-tracking in the control zone (irrespective of visibility)
is obligatory.
Note: Radar-tracking is an active kind of radar-tracking service.
3.1.29.When mooring and navigating in the TCS zone, vessels
are obliged to keep a permanent watch on VHF, channel 12.
3.2. NAVIGATION OF VESSELS
Movement of vessels
3.2.1.Movement of passenger vessels, gas-carriers, chemical-carriers,
ferries, tankers, barge-carriers and
ro-ro vessels within the control zone (VTCS) and of all vessels in Port
waters (TCS) is regulated.
3.2.2. Entering port waters and moving of all vessels
and floating craft without the TCS permit is forbidden.
3.2.3. A vessel must request the permit from the TCS for
all operations (entering control zone, anchoring, leaving anchorage, mooring
and leaving berth, shifting, mooring sidewise). If a vessel has not started
the permitted action or has not entered the control zone within 30 minutes,
the permit is cancelled and should be requested again.
3.2.4. In case of infringement of items 3.2.2; 3.2.3,
the fees for radar-tracking are collected at double rate.
3.2.5. Vessels are obliged to repeat the TCS recommendations
and orders that are addressed to them; if said recommendations and orders
may not be fulfilled, vessels should explain the reasons and inform on their
further intentions.
Note: All helmsmen and operators are strictly observe "Guidance on usage
of USW communication at sea" ˰ 9044
3.2.6. During the first radio contact with the TCS the
vessel should submit the following information:
- name and type of the vessel;
- time of approaching to control zone or of leaving the berth;
- speed in maneuverable mode;
- national and departmental affiliation;;
- address of the consignee, kind and quantity of cargo;
- gross and net register tonnage;
- length overall, width and draught of the vessel;
- other information on request of the TCS pilot-operator.
The Master is responsible for authenticity of this information.
3.2.7. On the TCS demand and with the purpose of vessel
identification, the latter must report her bearing and distance from Illichivsk
lighthouse or execute an identification manoeuvre coordinated with the TCS.
3.2.8. Afterwards, the TCS issues the permit to the identified
vessel for entering the control zone, specifies the route and gives the
other necessary information, including warnings and restrictions.
Navigation at poor visibility
3.2.9. Radar-tracking pilotage of vessels into the port
at poor visibility is obligatory. Radar-tracking pilotage of passenger vessels,
gas-carriers, chemical-carriers, ferries, tankers, barge-carriers and ro-ro
vessels is obligatory irrespective of the visibility.
Depending on the situation, the radar-tracking pilotage can be prescribed
by a decision of the TCS pilot - operator.
3.2.10. A possibility of entering and leaving the port
under radar-tracking pilotage is determined by the Master of the vessel,
a Port pilot and the TCS pilot-operator in common.
The final decision on a necessity of radar-tracking pilotage is taken by
the Master of the vessel.
3.2.11. At limited visibility only one vessel there can
be piloted by the TCS.
3.2.12. The Coastal Radar-Tracking Station may pilot only
those vessels that have serviceable main engine, steering and anchor gear,
radar, VHF equipment, gyrocompass and sound alarm.
During radar-tracking pilotage the Master of the vessel must be ready to
take measures to ensure safety of the vessel in case of a sudden failure
of the Port Coastal Radar Station or communication link between vessels
and the TCS, as well as of the mechanisms and arrangements listed in this
item. Pilot - operator must be immediately informed about such failures.
3.2.13. If the Master of the vessel makes use of the information
supplied by the Port Coastal Radar Station, he is still not relieved of
the responsibility for vessel control and safe navigation.
3.2.14. At visibility less than 500 m, all traffic of
passenger boats (inside the Port or in the roads) must be immediately terminated.
Traffic is allowed only for pilot boats and boats with the inspection commission
on board, that have serviceable radar system, two navigators who have been
trained in a radar-simulator, and under Coastal Radar Station pilotage.
3.2.15. Traffic of auxiliary vessels (bunkering ships,
tugs, water barges, shipchandler's, etc.) at visibility less than 2,000
m - in the outer roads, and less than 1,000 m - in internal port water area,
is allowed only for those vessels that are equipped with a serviceable radar
system, have a navigator trained with in a radar-simulator, proceed independently
and are piloted by the Coastal Radar Station.
Possibility of such vessels traffic in each concrete case is solved by the
TCS pilot -operator.
3.3. TRAFFIC CONTROL OF NAVY SHIPS AND SUPPORT VESSELS
3.3.1. Navy vessels arriving to the Port are guided by
the general rules and these CR to the appropriate extent.
3.3.2. The Harbour Master is the senior official ensuring
traffic control of navy ships and vessels in Port area, at approaches and
in fairways.
3.3.3. Navy ships and support vessels obtain a permit
to enter the Port from the Harbour Master. They should request such permits
not later than 4 hours before entering the Port. When a ship is approaching
the VTCS zone (proceeding at two miles' distance from the zone), she should
establish communication on 16th VHF channel and inform her number, position,
speed and time of arrival to the Port reception buoy. After this moment
the communication with the VTCS (TCS) is maintained permanently.
3.3.4. Navy ships and support vessels may leave the port
with the permit of the Harbour Master as well; such permit is requested
not later than 1 hour before the departure. In 15 minutes before the departure
it is necessary to establish communication with the TCS.
3.3.5. Navy ships and support vessels staying within the
VTCS control zone and Port waters (control zone) navigate under the TCS
control.
3.3.6. Navy ships and support vessels have priority in
entering and leaving the port with the exception of emergency situations
in the Port.
4. SPECIAL CASES OF VESSELS NAVIGATION IN PORT WATERS
4.1. TOWAGE OF VESSELS IN PORT WATERS
Towage control
4.1.1. Towage is allowed at wind speed not exceeding 14
m/s.
4.1.2. All vessels having length of 100 m and more are
obliged to use tugs at mooring operations. If thrusters are provided, towage
is not necessary.
Depending on weather conditions, additional tugs can be ordered by the Master
as agreed with the pilot.
4.1.3. The tugs towing vessels, lighters and other floating
craft of 1,415 m3 gross capacity (500 reg. ton) and larger in Port waters
operate under command of the towed vessel Master.
4.1.4. Towage of vessels and floating craft of gross capacity
less than 1,415 m3 (500 reg. ton) and of non-self-propelled port fleet vessels
- irrespective of their gross capacity - is carried out by the navigator
of a towed vessel, if it is not provided otherwise in the towage contract.
The officer in charge of towage is responsible for damage of tugs and towed
vessels, hydrotechnical facilities and arrangements, and vessels anchored
or moored to dolphins or berths.
4.1.5. The Port does not bear responsibility for damage
and accidents that have occurred during towage operations if the towage
is managed by the vessel that hired the tug. All Port losses in connection
with damage and expenses during towage are paid for by the head of towage
(the vessel that hired the tug). The responsibility begins from the moment
when the tug starts to fulfil the first instruction given by a vessel that
hired the tug and terminates at the moment when the vessel that hired the
tug declares the end of towage.
4.1.6. The towing cable length, when towing floating
craft in the Port water area and in the entrance channel should not exceed
50 m.
4.1.7. Masters of tugs are forbidden to leave barges and
other non-self-propelled floating craft in Port waters lying at anchor without
the permit of the TCS pilot-operator and co-ordination with the Harbour
Master.
4.1.8. The Master of the vessel is responsible for safe
lying of a floating craft moored alongside a vessel.
4.1.9. Tugs meet the arriving vessel after she leaves
the access channel and accompany the vessel to the channel when the vessel
sails from the Port.
Request for towage
4.1.10. The Master of a vessel requests tugs via the agency
company not later less than 2 hours before the vessel is ready for towage.
The Master of a vessel calls tugs 45 minutes before the vessels is ready
to sail or shift, or vessel's arrival from the sea to the gates of the Port
via the pilotage service operator. The call-sign is: "Illichivsk, radio-29
channel 73".
Taking vessels for towing
4.1.11. The vessels provided with bulbs throw the tow
rope with the aid of the heaving line.
4.1.12. A vessel longer than 150 m with shutdown main
engines or steering gear must, when being towed in Port waters, make exhibit
lights and colours prescribed by Rule 27 of COLREG-72, in addition to the
lights prescribed by Rule 24.
4.1.13. Towage of vessels working (working up) their
main engines should be effected with the shortest possible tow cable so
as to ensure safety of towage.
4.1.14. During towage of non-self-propelled vessels with
stern gear, a helmsman should stay at the rudder.
4.2.NAVIGATION IN ICE
General provisions
4.2.1.To manage pilotage in ice within Port waters, the
Port Manager annually appoints the command group in charge of pilotage in
ice headed by the Harbour Master.
4.2.2. Depending on actual ice conditions in port waters,
the Harbour Master announces the beginning and the end of ice period in
Port waters and informs the concerned bodies accordingly.
4.2.3. All services and departments of the Port are subordinated
to the Chief of command group for the period of ice campaign in connection
with all issues connected with ice operations.
4.2.4. The Head of Port fleet and all shipowners based
in the Illichivsk Port must annually submit to the Harbour Master the lists
of all vessels allowed to navigate in ice by the 1 December.
4.2.5. Establishment of priorities in entering and leaving
the Port, management of icebreaking means in Port waters is executed by
the Chief of command group in charge of pilotage in ice - the Harbour Master.
4.2.6. Under complicated ice conditions, priorities of
pilotage operations in ice are established at the working meeting with the
Harbour Master and entered in day-plans of icebreaking and traffic operations
(mooring) of the Port.
4.2.7. Masters of vessels navigating should take guidance
from the "Rules for vessels piloted by ice breakers in ice" and
by the "Instruction for communication of vessels navigating in ice".
4.2.8. The Masters of vessels that are not classified
for sailing in ice are forbidden to enter and navigate in ice.
Note: By way of exception, the shipowner may permit his vessel, that
has not been classified for sailing in ice, to move in ice by agreement
with the Chief of command group with the appropriate icebreaking support.
The responsibility for possible damage of such vessel during navigation
in ice stays with the shipowner.
4.2.9. The request for icebreaking support in entering
the Port should be submitted 48 hours before the operation begins, and specified
24, 12 and 4 hours before entering the VTCS control zone or the ice edge.
The request for icebreaking support when leaving the Port should be submitted
24 hours before the departure.
4.2.10. The request should indicate: the name of a vessel,
main dimensions, draught, main engines' capacity, daily stock of bunker
and water available, speed in clean water, propeller material, total quantity
of cargo, certificates for navigation in ice and the vessel's seaworthiness
at the time of approach to the Port.
4.2.11. Foreign vessels not authorized for ice navigation
are accepted for pilotage in ice only if the Master requests pilotage in
ice in writing and pays the expenses for repair of possible damage of the
vessel due to ice.
5. STAYING OF VESSELS IN PORT
5.1. GENERAL PROVISIONS
5.1.1. In dark time berths are fully illuminated.
5.1.2. The Masters of all vessels should keep up steam
and water outlets in the hulls thoroughly covered with wooden boards or
canvas.
5.1.3. Usage of ships' floating means for communication
with coast is prohibited. Communication with coast of vessels lying on anchor
is provided by floating means of port fleet. Requests for service is submitted
via the agent of a vessel. On single service (crew delivery, supply, etc.)
the separate request is submitted.
5.1.4. On vessels standing at berths it is forbidden to
conduct outboard works offside.
5.1.5. In case of violation by members of crew the General
Rules of standing in port or the public order they are imposed a fine.
5.1.6. Approaching of port fleet vessels or other departmental
vessels to foreign ships lying at berth or on roadstead may be executed
after obligatory notification of Frontier Authorities.
5.2. VESSELS LYING IN THE ROADS
5.2.1. Anchorage No.351 with depths to 19 m is intended
for vessels waiting for the entry to Illichivsk Port.
Vessels anchor independently. The anchored vessel should inform the TCS
on her bearing and distance from the Illichivsk lighthouse.
5.2.2. Anchorage of floating cranes, lighters, barges,
port grain loaders and other cargo-handling craft should be coordinated
with the TCS and the Harbour Master.
5.2.3. Large-tonnage vessels are obliged to take into
account their length and veered anchor chain length so as to stay within
the anchorage limits while making circulation.
When such vessels stay at anchor, they must organise a continuous underway
watch as well as permanent communication with the TCS on channel 16 VHF.
5.2.4. In the Port water area there are road berths equipped
with mooring buoys. The vessels stay here attaching their mooring lines
to the buoys and dropping anchors. Mooring lines are brought and fixed to
the buoys by a mooring team of the Port fleet and specially assigned boats
or tugs.
In case of emergency and in order to assist the tugs, the towing cables
lowered down to 2 m from water surface should be prepared from the bow and
stern of the vessel moored to buoys in the inner roads.
5.2.5. Anchorage of transport vessels in the inner rods
of the First and Second basins of the water area is forbidden.
In special cases the Harbour Master may permit a short time anchorage (2-3
hours) with obligatory towing support.
5.2.6. Vessels' stay in the roads of the Port is paid
in accordance with the rate (anchor dues) effective as of 1 July, 1993 for
all vessels that use anchorages.
5.2.7. Anchorages within the Port intended for the port,
auxiliary and technical fleet vessels are determined by the TCS so as to
provide for free manoeuvring
5.3. MOORING AT BERTHS
Preparation of berths for mooring vessels
5.3.1. All berths of the port are provided
with the outer marking:
- mooring bollards are painted white and numbered;
- at berth, near every mooring buoy, the number of the berth and distances
both sides to the nearest bollards are marked in a bright colour;
- berths limits with the indication of their length in meters are designated.
5.3.2. No cargo and extraneous objects are kept within
the 3 m wide berth strip (from the berth edge) to ensure safe work of the
shore team engaged in mooring operations. In winter time it is necessary
to clean this part of berths from ice and snow and dust it with sand.
5.3.3. Free length of a berth intended for mooring is
not less than 110 % of the overall length of the mooring vessel. In day
time the mooring place is designated with two (bow - stern) red flags, and
in night time - with lanterns. If no indicated signals are exhibited, the
berth is considered not prepared for mooring.
5.3.4. When preparing the berth for mooring a vessel,
all works connected with safe arrangement of berth gantry cranes and container
reloaders are carried out by the dispatcher (terminal stevedore) according
to the instructions of the Port mechanization department.
5.3.5. The dispatcher (terminal stevedore) reports to
the Port dispatcher on the berth readiness. Then the Port dispatcher notifies
on the berth readiness the head of ISPS shift, the pilot and the TCC operator
and appoints the time for the vessel to leave the anchorage and moor to
the berth.
In any case the pilot, before coming to vessel, is obliged to verify that
the berth is ready to receive the vessel to report to the dispatcher of
port and head of the ISPS shift.
5.3.6. Mooring of vessels to berths that are not properly
prepared is forbidden.
If the pilot left for a vessel while the berth is not prepared to receive
the vessel, the ISPS representative (Port supervision captain-on-duty) should
inform the pilot and dispatcher of the Port accordingly. The vessel proceeding
to the berth is to be anchored at anchorage No. 351 or in the inner roads
(towage is obligatory) until the berth is completely ready.
The pilot draws a report on violation of Compulsory regulations in every
such case.
5.3.7. When mooring or pulling a transport vessel alongside,
it is necessary that, besides linesmen, the shift dispatcher (stevedore)
of the terminal and the port supervision captain-on-duty are present at
the berth with the VHF portable radio station to communicate with the TCS
and the pilot on board.
5.3.8. It is forbidden to moor transport vessels to berths
at wind speed exceeding 15 m/s.
5.3.9. At wind speed exceeding 10 m/s, mooring of vessels
alongside other vessels is forbidden.
On a vessel, to which side another vessel is mooring or unmooring, the cargo
operations and walking of people on decks should be stopped during the whole
period of mooring.
5.3.10. Alongside mooring in the rods is forbidden when
the wind speed exceeds 8 m/s.
Approach to berths and mooring operations
5.3.11. When mooring, unmooring or pulling vessels alongside,
the shift dispatcher (stevedore) of the terminal and the port supervision
captain-on-duty are obliged to be present at the berth.
5.3.12. Delivering or clearing off the lines at mooring
operations in the port are carried out by the VTCS mooring team.
5.3.13. The Master should lodge to Port authorities all
claims regarding a damage of the vessel inflicted during mooring or cargo
operations not later than 8 hours after the accident. In case the vessel
is due to depart before the expiration of this term, the claim should be
submitted beforehand. After expiration of the 8-hour period the Port does
not accept the claims and, also, does not bear responsibility for the damage.
5.3.14. The following operations in the Port are forbidden:
- mooring vessels alongside other vessels in the First basin of the
Sukhyi Firth;
- mooring a vessel alongside the smaller size vessel;
- mooring a vessel in ballast to a loaded vessel of identical size;
- mooring of passenger, scientific and training vessels alongside each
other;
- mooring vessels with unserviceable main engines and steering or anchor
arrangements alongside other vessels staying at berths;
- mooring of vessels to unserviceable berths;
- performance of repair and adjusting works on the radar-tracking systems
under high voltage without the permit of the ISPS.
Lights on vessels standing at berths
5.3.15. Vessels moored at berths for cargo operations
with the hull extending beyond the berth limits must exhibit: in day time
- "ROMEO-YANKY" flag ("You should pass by at small speed");
at night - one red light visible around all quarters. Besides and irrespective
of the purpose of staying, the vessel should exhibit at night the red light
lowered to 2-meter level above the water from the bow or stern to indicate
the maximum extension of the vessel out of the berth limits.
Staying of vessels at berth
5.3.16. A vessel must have the under-keel clearance of
at least 0.3 m.
5.3.17. On demand of the Port authorities, the vessel
is obliged to slack away the mooring lines, transfer them or change a place
of mooring.
5.3.18. Pulling of vessel alongside a berth for a distance
over 100 m is considered to be remooring and is carried out with a pilot
on board and with the aid of tugs. In doing so, the following restrictions
are valid:
- vessels in ballast and vessels having on board the cargo not exceeding
20% of her deadweight (excepting high-tonnage vessels) are re-moored
at wind speed not exceeding 15 m/s;
- high-tonnage vessels in ballast or ro-ro, ro-flow vessels, lighters,
tankers, container-carriers and similar vessels having on board the
cargo not exceeding 20% of her deadweight (because of high sail area)
are shifted at wind speed not more than 12 m/s;
- shifting of vessels with unserviceable main engines and/or steering
or anchor arrangements is made only in light time of the day at wind
speeds not exceeding 10 m/s;
- shifting of pneumatic loaders, floating cranes and non-self-propelled
floating port craft is carried out under weather conditions defined
in their Register documents at any time of the day, provided a sufficient
towing support is available.
5.3.19. Mooring vessels alongside other vessels is carried
out at wind speed not exceeding 10 m/s and at the visibility of at least
500 m, with the consent of the Masters of both vessels.
5.3.20. On completion of cargo or other operations, each
vessel unmoors from the berth or is taken from the internal port water area.
Staying at berth after termination of cargo operations necessitates a permit
of the Port authorities.
If the requirements of this item are not met, such vessel is taken from
the berth by the Port means and at the shipowner's expense. In doing so,
the shipowner bears a full responsibility for the losses connected with
delayed clearing of the berth.
5.3.21. Vessels can be moored to berths so as to fully
utilize the depth for loading to full tonnage, also with the aid of floating
berths, barges etc. In similar cases the above stated method is to be agreed
with the Harbour Master, the permit for these actions is given by the Harbour
Master separately.
The terminal administration is responsible for installation of a floating
berth or barge, and, also, means of communication with the coast via these
means.
The Master of a vessel is responsible for installation of a gangway above
the floating berth (lighter, barge). Gangways are kept in hanging position
so as to provide safe descent on the floating berth.
5.3.22. In case of "rough sea" caused by swell
penetration into the port water area, a vessel moored to berth No.18 terminates
cargo operations and is taken to a safe place specified by the ISPS.
5.3.23. Vessels staying in the Port are prohibited to
use ship typhoons, except in emergencies.
Staying of nuclear vessels
5.3.24. Nuclear vessel should submit the information on
their approach three day in advance and specify it 24 and 4 hours before
arrival.
5.3.25. The TCS indicates the arriving nuclear vessels
their anchorage place in the outer roads where the vessels are subject to
control and other formalities.
5.3.26. Besides standard ship documents, a vessel should
submit special documents for nuclear vessel.
5.3.27. Safety of environment is controlled by measuring
the level of background radiation both by the nuclear vessel and instruments
of the Port.
5.3.28. In case of a radiation danger, the vessel is
to be guided by the ship and Port emergency plans.
5.3.29. Dumping of solid and/or liquid (except waters
after sanitary treatment facilities) radioactive waste in Port waters is
forbidden.
5.3.30. Discharge of gasiform reactive waste should meet
the requirements of the effective State regulations and standards of Ukraine
and be agreed with the Port administration.
5.3.31. Unloading of radioactive waste from foreign vessels
in the Port and Port waters is forbidden.
Actions at storm
5.3.32. Upon receiving a storm warning about strengthening
of wind from east directions (0°-90°-1800) up to 22 m/s:
- auxiliary vessels and small craft should be led into port and reliably
moored to berths;
- all other vessels should anchor at anchorage No.351 or leave for the
open sea;
- the listed above rearrangement of vessels in the roads is carried
out according to instructions, with the permit and under supervision
and tracking of the TCS.
5.4. STAYING OF SMALL CRAFT AND FLOATING MEANS IN THE
PORT
5.4.1. All small craft and Port fleet floating means are
moored, as a rule, near berths No.24 and No.25 or, with the permit of the
Port dispatcher-on-duty and of the ISPS (TCS) - at free port berths.
5.4.2. Mooring vessels and floating means of other departments
to berths No.24 and No.25 is prohibited without co-ordination with the Port
fleet administration.
5.5. WINTERING AND LAYING-UP IN THE PORT
5.5.1. Ships of the port fleet and of the other departments
that are not of the ice category are laid-up in the Illichivsk port for
the period of ice situation.
5.5.2. Auxiliary vessels, small craft, passenger boats,
bunkering ships and floating means of the Port fleet and other departments
stay for wintering near the floating piers moored to berths Nos. 24 and
25.
5.6. PREVENTION OF PORT WATER AREA POLLUTION
WITH OIL PRODUCTS, HARMFUL SUBSTANCES AND SEWAGE
5.6.1. All vessels staying in port water area and in the
roads, and all enterprises, organisations and institutions located on its
territory (or those that discharge into the Port water area) are obliged
to observe the requirements of legislation of Ukraine on environment protection.
All actions that may lead to environmental pollution of the territory and
water area of the Port should be co-ordinated with the Port authorities.
The persons (shipowner, Master, etc.) guilty of violation of the provisions
of legislation on environmental protection are called to liability.
5.6.2. All vessels, irrespective of their departmental
affiliation and the flying flag, that arrive to the Illichivsk Port are
obliged to prove their conformity to MARPOL 73/78 International Convention
requirements by submitting the International Certificates on prevention
of sea pollution with oil, sewage and garbage.
Vessels not corresponding to the requirements of the MARPOL 73/78 International
Convention and national requirements of Ukraine on environment protection
are not admitted to the Port.
5.6.3. The Service of labour safety and ecology protection
of the Port and the Illichivsk Basin Sanitary & Epidemiological station
control the observance of the legislation of Ukraine on environment protection.
The ISPS supervises the observance of all requirements on prevention of
environmental pollution and checks conformity of vessels calling at the
Port to the requirements of International Conventions and National Regulations
of Ukraine on Environmental Protection.
5.6.4. All vessels during their stay in the Illichivsk
port waters and all enterprises and organizations located on its territory
(or discharging in the port water area) are forbidden to dump in water the
substances harmful for human health or life at sea, in particular:
- oil, oil products, oil residues and, also, the mixtures containing
them in any concentration, including waters treated by shipboard installations,
ballast water from fuel/ballast and oil tanks, clean ballast;
- chemical raw materials and chemical products after cleaning and washing
decks, cargo holds and tanks;
- non-treated sewage and, also, waste water after the shipboard physical
and chemical treatment facility. Discharges from the shipboard faecal
system are to be stored in accumulation tanks and all outboatd valves
should be sealed;
- any other sewage if its discharge changes the colour, smell and transparency
of seawater or leads to appearance of visible floating fractions;
- garbage or food waste, remains of any cargoes and separation used
for its transportation.
5.6.5. In order to prevent pollution of Port waters, the
Master of a vessel is obliged:
- before entering the territorial waters of Ukraine, to close and seal
up the valves and other arrangements through which harmful substances
may be discharged whereof an appropriate entry is made in the Log-book;
- for the period of any operations with oil, oil products, oil polluted
waters and other harmful substances, all deck scuppers should be hermetically
closed, pans should be placed under hose connections with the use of
ventilation pipes, and all such operations should be thoroughly controlled;
- ship's works (removal of paint by hammering and hull painting, washing
decks, holds and other parts of the vessel) and repair works should
be conducted after co-ordinating them with the ISPS so as to ensure
obligatory observance of the measures that exclude pollution of port
waters .
- to demonstrate to representatives of the Port or State Inspection
on Protection of the Black Sea that all valves and arrangements through
which the environment may be polluted are sealed up and to bear responsibility
for sealing all such valves and arrangements.
5.6.6. In case harmful substance have been accidentally
discharged outboard, the Master of a vessel is obliged to immediately inform
the Harbour Master and the State Inspection on Protection of the Black Sea
(tel. 18-48; (7) -25-14-47) as soon as possible (by radio, telephone, courier).
Upon detection of environmental pollution, it is necessary to report by
the same telephone numbers, specifying exact position of spill, that nature
and direction of spill movement.
5.6.7. All vessels are forbidden to use the substances
that sunk oil to bottom or dissolve it in water in order to clean the port
water area.
5.6.8. A vessel caught inside the emergency spill of oil
or oil products should not begin to move until she receives a special permit
of the person in charge of emergency spill liquidation.
5.6.9. All vessels and floating means are forbidden to
cross the polluted water area. When passing near the area of oil collection,
the vessel should proceed at a dead slow speed.
5.6.10. Administration of the vessel must present, if
requested, to present ship documents according to MARPOL - 73/78 Convention
requirements.
5.6.11. The vessels that enter the Black Sea with a view
to proceed to Illichivsk Port are obliged to replace the separated ballast
taken in the other regions of World ocean to ballast water of the Black
Sea with appropriate notice in the Log-book.
Discharge of separated ballast should be carried out only by ships' pumps
specially intended for this purpose and by separate pipelines.
Discharge of separated ballast outboard within the port water area may be
carried out only after laboratory analysis of the contents of oil, iron,
suspended substances and obtaining permit from the State Inspection on Protection
of the Black Sea.
Discharge is carried out in light time of the day and is to be supervised
by a representative of the Inspection of State Port Supervision.
5.6.12. During bunkering, cargo operations with vegetable
oils and other polluting liquid cargoes it is necessary to boom preliminary
the area of operations. This service is carried out by the Port fleet and
force, and the payment is collected according to the established rate.
5.6.13. All vessels are forbidden to remove and dump garbage,
industrial and household waste, including separation materials, on the territory
of the Port without a special permit. Polluted water areas and territory
of the Port are cleared at the expense of the polluter.
5.6.14. Food remains and garbage are removed from vessels
packed in polyethylene bags (containers) delivered to vessel by the Port
at request via the agency companies. Contents of polyethylene bags (containers)
are taken to the special dumping site by Port transport. This service is
included into sanitary dues.
All food remains and production wastes (garbage) collected at ship during
its stay in the Port should be transferred to the Port before sailing whereof
an appropriate certificate is issued by the port fleet authorities. The
vessel may not sail in the absence of the document that confirms transfer
of garbage.
5.6.15. During their stay in the Port all vessels are
obliged to connect to a shore power source with payment according to the
fixed rate. Shipboard mechanisms that produce electric power must be switched
off.
5.6.16. If such connection is impossible for technical
reasons, the vessels are charged (at fixed rates) for emission of harmful
substances from ship's diesel-generators and boilers during stay at port
berths.
5.6.17. It is forbidden to do the following:
- emit dense smoke and gases that pollute atmosphere,
- use the ship's incinerator for waste burning (incinerators' furnaces
are sealed up);
- dump rubbish or snow into water or on ice from berths and ships;
- clean the underwater part of hull when lying at berths and in the
inner roads.
5.6.18. With the purpose to prevent dusting when handling
bulk (chemical) cargoes at wind speed exceeding 10 m/s, the works are to
be terminated.
5.6.19. Enterprises (organizations) that are located in
the Port territory and are independent legal entities bear full responsibility
for condition of Port waters adjoining to berths that they rent.
5.6.20. Shipowners and managers of enterprises that violate
the CR as regards environmental protection should refund all expenses for
liquidating pollution and its consequences according to fixed rates as well
as the Port expenses for renting equipment, floating means and personnel
of other enterprises and, also, the refund the pollution fines paid by the
Port.
6. PROCEDURE OF USE OF RADIO COMMUNICATION MEANS IN
PORT WATERS
6.1. All vessels navigating in the Control Zone are obliged
to have serviceable VHF radio telephone stations (RTS) which should kept
switched on the 12th channel that provides for communication with the VTCS.
6.2. Within the limits of Illichivsk Port zone the following

6.3. Vessels staying within the limits of the Illichivsk
Port Control Zone (at anchorages, at berths and in transit) may use VHF
of the Central Port Radio Station for private communication provided free
radio channels are available.

8. PROCEDURE, SAFETY AND SAFE KEEPING OF STRUCTURES
IN PORT WATER AREA
8.1. NAVIGATION OF SMALL CRAFT
8.1.1.Persons who own yachts, launches, boats and other
floating craft must strictly adhere to the requirements of item 3.1.10 of
these CR. They are prohibited:
- to use floating craft not registered with the Technical
Navigation Inspection of Small Craft;
- to keep and navigate them within the Port water area.
8.1.2. Sports stations, marinas and other organizations
conducting public sports competitions (regattas, races, tours, etc.) in
the Control Zone must inform the Harbour Master in writing at least 3 days
in advance. The harbour master should receive the appropriate diagrams in
3 copies.
Floating craft that assist to conduct the above sports activities must be
equipped with VHF radio telephone stations and maintain permanent watch
on call channel No.16.
Sports stations and other organizations conducting sport activities are
responsible for preparation and safe navigation of sport craft at sea.
8.2. FISHING IN PORT WATERS
8.2.1. Fishing in the internal port water area from berths
as well as from any other floating means is prohibited.
Industrial fishing in port waters is allowed, if specified in contracts
between fishing farms and the Illichivsk Sea Commercial Port.
8.3. NAVIGATIONAL AIDS
8.3.1. Masters of vessels that detected in port waters
and in the Control Zone any floating objects that are dangerous to navigation
must immediately inform the TCC pilot-operator.
8.3.2. If a vessel inflicts damage on a navigational
buoyage, the Master must immediately inform the TCS pilot - operator, who
must urgently report this case to the ISPS in order to notify mariners and
take measures to restore the damaged buoyage.
The TCS operator is obliged to permanently inform all vessels navigating
in the Control Zone that this particular navigational aid is out of order
until the time when it is repaired.
8.3.3. Any construction of new facilities or reconstruction
of the old ones located in the area of navigational aids or on the leading
lines is prohibited without co-ordination with the Harbour Master, Naval
Staff of the Black See Fleet and organizations that are in charge of this
navigational aid.
8.4. SOUNDINGS AND DREDGING WORKS
8.4.1. Performance of soundings and dredging works without
the permit of the Harbour Master are prohibited.
Before proceeding to works, the Master of the dredger must submit the positioning
diagram of anchors, bow and side cable lines to the Harbour Master.
8.1.5. The vessel that carries out soundings should raise
signals and lights according to the Rule 27 (b) of COLREG-72.
It is necessary to pass by such vessel at a slow speed and only after the
signal is given indicating the passing side.
9. ORDER, GUARDING AND TRAFFIC IN PORT TERRITORY
9.1. PASSAGE SYSTEM AND PORT GUARDING
Passage system
9.1.1. The fixed limits of the territory and water area
of Illichivsk Sea Commercial Port are designated as restricted areas and
are guarded by Port guards and Frontier Detachment "Chornomorya".
9.1.2. Entry of persons and vehicles in the Port territory
is allowed through control checkpoints:
- main checkpoint located opposite berth No. 6;
- second checkpoint located opposite berth No.11;
- third checkpoint located opposite berth No.24.
Offices for issuing passes are located at all checkpoints.
9.1.3. Every person staying in the restricted area of
Illichivsk Sea Commercial Port must possess a port pass or other documents
that entitle such person to stay within the Port territory and produce such
pass on first request to Port or Frontier guards.
Persons in possession of passes without photos (single-time pass or temporary
pass) must produce their identification documents.
9.1.4. In order to ensure safety of vessel and to control
visits of persons who are not crew members, the Master must organize a watch
at the gangway during the entire period of vessel's stay in the Port.
Border Guard representatives check the watches on vessels.
9.1.5. Persons who are not in the crew list, except for
close relatives of the crew members of foreign navigation vessels, may not
live on board such vessels.
Cargo guarding
9.1.6.The shipowner is liable for guarding of vessels
staying in the Port and of their cargo.
9.1.7. Open sites, where cargo is temporary stored, that
should be passed over to the Port guards for guarding they should be well
illuminated and enclosed with a line fencing.
9.2. TRAFFIC AND PARKING OF TRANSPORT. PEDESTRIAN MOVEMENT
9.2.1. Speed of transport within the territory of the
Port should not exceed 30 km/h and is indicated by road marks.
9.2.2. Entry of private vehicles into the Port territory
is regulated by the order of the Port manager "On Passage System and
Control in the ISCP".
9.2.3. Pedestrian movement is carried out by the designated routes. Crew
members of foreign vessels pass in the Port through the main control checkpoint
only.
9.2.4. Manoeuvring railroad locomotives should move in the port territory
at speeds not exceeding 5 km/h and signal about their approach to crossings.
Dispatcher of cars should beforehand check up the tracks to make sure that
there is a free track for the passage of cars.
9.2.5. Within the limits of Illichivsk Sea Commercial Port it is forbidden:
- to take photos and shoot films without the permit of the Port manager
and Frontier authorities (FD "CHORNOMORYA"):
- to shoot with all kinds of weapon;
- to open fire valves and hydrants;
- to sell or bring and consume alcoholic drinks:
- to spoil any sort of flower beds and planting: trees, flowers, bushes.
- to make fires, burn grass, dry branches, separation etc.
9.3. PASSENGER OPERATIONS IN PORT
9.3.1. Passengers are carried to vessels lying at anchor
in the Port water area and in the outer roads from berths Nos. 4 and 5.
Parking at these berths is allowed only during time of embarkation and landing
of passengers.
Masters of longshore should check the passengers' documents, to determine
their legality for going in the roads and to inform the Checkpoint on all
cases of detecting persons without required documents.
9.3.2. Passenger traffic between the Port and vessels
lying in the outer roads is carried out of at least 1 mile visibility and
at swell not exceeding 2 points.
9.3.3. Port fleet passenger boats carry passengers in
the Second basin of the Port, between the northern and southern coasts of
Sukhyi Firth: from berth No.25 to the passenger floating pier of Burlacha
Balka settlement.
10. FIRE-PREVENTION IN THE PORT
10.1. GENERAL RULES OF FIRE-PREVENTION IN THE PORT
10.1.1. Road vehicles carrying dangerous cargoes should
be equipped and supplied with fire-extinguishing means according to standards
of the Fire Safety Rules.
Diesel locomotives, motor vehicles, lift trucks and mobile cranes may not
approach stacks of cotton, jute and other fibrous cargoes closer than 5
m, and tractors not equipped with spark arresters at exhausts - not closer
than 10 m.
10.1.2. Cargo handling in warehouses with lift trucks,
trucks and other mechanisms equipped with internal combustion engines without
spark arresters is prohibited.
10.1.3. Surface temperature of the running processing
equipment should not exceed the ambient air temperature by more than 45°C
(in any case it should not exceed 60°C).
10.1.4. It is prohibited to use electric heaters without
a special permit of the Electrical Department and Fire Brigade of the Port.
Usage of makeshift steel furnaces for heating premises (rooms) in the Port
is forbidden.
10.1.5. During the entire period of handling inflammable
cargo and by request of the Fire Brigade management, the Terminal manager
(Port department) must arrange, fire stations near the cargo handling area.
10.1.6. It is forbidden to pile up bollards, fire hydrants
and water taps with cargo and block up emergency accesses. Free space near
fire taps should have a radius not less than 4 m, and near the fire-engine
parking and access to sea - not less than 9 m wide.
10.1.7. Storage and use of substances and materials of
unknown fire and explosive properties is forbidden.
10.1.8. Storage of fibrous materials (cotton, jute, hemp,
rags, etc.) in open sites is allowed only at distances:
- not less than 5 m from a stack to the electrical cabinet
of gantries or electric supply lines;
- not less than 10 m to the railroad track rail head.
10.1.9. Observance of fire safety rules at facilities
and checks of the actual condition of all fire-fighting tools is carried
out by departmental fire team.
10.1.10. All fire pumps of terminals and Port departments
should be kept in full readiness, their pressure should be checked every
10 days in operation (make a relevant note in the log-book).
10.1.11. Territory of refuelling stations and open sites
where liquids are stored in containers should be kept clean, and spilled
inflammable and combustible liquids must be collected in time.
10.1.12. Processing equipment of wood-working shops,
devices and electrical equipment should be cleaned of wooden dust, shavings
and other inflammable materials at least once per shift, and building structures
and lamps - at least once in two weeks.
10.1.13. All computer units together with the associated
assemblies, cable ducts, etc. that belong to the Computer Centre should
be cleaned of dust once per quarter.
Special premises designated for washing out of separate units with combustible
liquids should be provided with plenum and exhaust ventilation.
10.1.14. It is prohibited to block up passages, doors,
locks and stairs with various articles and equipment. All doors of emergency
exits should open easily towards the exit. In case of fire it is necessary
to ensure a possibility of fast and safe escape of people and removal of
material valuables stored in industrial buildings.
10.1.15. Crossings and passages across railways in the
Port should be always kept free for fire engines and must have a continuous
floor at the same level as rail heads. It is forbidden to leave railroad
cars without locomotives at crossings.
10.1.16. All hot spots and facilities of the Port should
be provided with well visible all-round-the-clock warning inscriptions in
Russian and English "NO SMOKING", "FIRE HAZARD", "DO
NOT USE OPEN FIRE", etc.
Such inscriptions should be installed in accordance with the Fire Brigade
of the Port. Terminal managers and heads of enterprises, organizations and
institutions located in the Port territory.
10.1.17. All works requiring use of open fire in the Port
territory and on board vessels staying in the Port are conducted only with
the permit of the Fire Technical Service of the Port Guards.
10.1.18. The trains staying in the immediate proximity
to moored vessels must be arranged so as to have a gaps of at least 4 m
near gangways that ensure entrance aboard vessels.
10.2. FIRE SAFETY ON BOARD VESSELS STAYING IN THE PORT
Control of fire safety in the Port is carried out by the Fire Technical
Service of Port Guards (FTS).
10.2.1. Bunkering vessels lying at berth of dry-cargo
port and roadstead with liquid fuel is effected from bunkering ships. Bunkering
operations in port, as a rule, are conducted in day time. The port authority
may permit to conduct bunkering at night time. Additional measures of fire
safety should be accepted. Place of bunk receiving and region of works should
be additionally illuminated. Measures to prevent flood of bunk should be
taken. Bunk reception or delivering from automobile tanks is carried out
only with port FTS agreement.
10.2.2. Bunkering operations in the outer roads are carried
out only with the permit of Port authorities. A possibility of such operation
is defined by Port authorities together with the Masters of the vessel taking
part in bunkering operations, depending on weather conditions.
10.2.3. During cargo handling operations with inflammable
or explosive cargoes at berths of the dry cargo port, additional fire watch
should be kept on board or a fire boat watch should be put out. The Master
of the vessel must submit a request for such fire watch or the watch of
a fire-boat, and cover expenses associated with the additional fire watch
according to fixed rates.
Cargo handling operations with the above mentioned cargoes are forbidden
if the Masters of vessels do not meet the requirements of this item.
10.2.4. Mooring of bunkering ships alongside is prohibited
if one of them has the first or second category cargo on board.
10.2.5. Mooring tankers with cargo or ballast with degassed
tanks as well as the vessels carrying the 3rd category cargo may be allowed
only with a special permission of the FTS of the Port.
Mooring tankers in ballast with non-degassed tanks to Port berths is prohibited.
10.2.6. Towage of non-self-propelled vessels carrying
inflammable cargoes and executing works necessitate that the involved tugs
and towed vessels have a permit of the Register and FTS and are provided
with at least two steel fire lines (on forecastle and stern) lowered down
to 2 m above the water level, and exhausts of internal combustion engines
should be equipped with spark arresters.
10.2.7. The vessel carrying a dangerous cargo on board
or engaged in bunkering operations should exibit such signals:
- at day time - flag "BRAVO" according to COLREG-72;
- at night - a red light visible for at least 2 miles around all quarters.
11. CONSTRUCTION, OPERATION AND SAFETY OF PORT
STRUCTURES
11.1. OPERATION OF PORT STRUCTURES AND FACILITIES
11.1.1. All structures located on the port territory
should have technical certificates.
11.1.2. Owners of all buildings and structures located
in the Port territory and areas near the Port must keep them in good
technical condition. Outer appearance of buildings and structures should
be neat, and adjoining territory within 20 m distance should be permanently
kept in good order and cleanliness.
11.1.3. Organizations of all kinds of properties located
in the Port territory are obliged, at their own expense, to clean their
sites, warehouses, berths and other places on a daily basis.
11.1.4. Clearing rail tracks of garbage, snow and
ice near the warehouses that belong to the Port and are operated by
the Port is effected by the Port at its own expense.
Clearing of all other rail tracks is to be effected by the Railway administration.
11.1.5. All organizations, enterprises and institutions
located in the territory of Illichivsk Sea Commercial Port, or in the
alienated territory that is adjacent to the Port territory, must participate
in cleaning roads of common use. Sites to be cleaned are attached to
this or that organization by the order of the Port manager and should
be brought to notice of appropriate organizations
11.2. SAFETY OF HYDROTECHNICAL STRUCTURES
11.2.1. Vessels staying at Port berths are prohibited
to work propellers. As exception, working propellers is allowed for:
- diesel vessels - at the slowest speed before swinging off the berth;
- steam ships - to warm up engines before sailing (before beginning
to work the main engines) only with the permission of the Harbour Master,
provided that engine works at slowest speed and the distance between
propellers and the berth is at least 10 m.
11.2.2. All damage caused by a vessel to Port structures
should be repaired at expense of the shipowner (if the documents that
prove the vessel's fault are available).
11.3. MEASURES TO PREVENT DAMAGE OF UNDERWATER
CABLES AND PIPELINES. DIVING WORKS
11.3.1. The areas prohibited for dropping anchors
and dragging of various objects along the bottom (including anchors)
are specified on nautical charts.
11.3.2.Diving works in the Port may be effected, if
authorized by the Harbour Master only.
The Master of vessel or an ordering organization requests the Harbour
Master for a permission for diving works. The Master of the diving boat
should ask the TCC's permission before proceeding to works.
12. SANITARY AND QUARANTINE RULES IN THE PORT
12.1. Sanitary and quarantine inspection of all vessels
arriving and leaving the Port is executed all round-the-clock.
Masters of all vessels proceeding from foreign ports must inform the
Sanitary and Quarantine department (SQD) via agencies about the sanitary
and epidemiological situation on board, as well as presence of infected
and high-temperature crew members or passengers on board.
12.2. The agent notifies the Sanitary & Quarantine
department on the estimated time of arrival of Ukrainian and foreign
vessels from abroad by telephone 12 hours prior to arrival and, if the
passage time is less than 48 hours - not later than for 6 hours in advance.
The telephone message for SQD should contain the following information:
vessel's name, port of call, flag, number of crew and passengers and
their health condition, availability and type of sewage disinfection
system, cargo information.
If the Master reports on unfavorable situation on board or a presence
of sick crew members or passengers, the vessel should be anchored at
anchorage No.351 (according to the TCS instructions) and await the orders.
12.3. After the vessels arrives to the Port, the Master
is obliged to submit to SQD the following documents:
- sea sanitary declaration;
- 1 copy of the crew list;
- general and cargo declarations;
- information on toxicological (radiation) safety of cargo;
- information on the available and serviceable shipboard sewage
disinfection system, or a storage tank;
- other documents stipulated by Conventions and Agreements.
12.4. In case a vessel carrying fumigated cargo (grain,
cereals, etc.) approaches or lies at anchor in the roads, sanitary inspection
is arranged including a toxicologist who assesses whether it is safe
for the commission members to work in the fumigated zone.
12.5. Berth No.28 is allocated for implementing anti-epidemiological
measures and gas deratization of vessels. The berth should be vacant
during such operations, power supply and free accesses for vehicles
should be provided. The berth territory should be illuminated in dark
time and equipped with a serviceable hydrant and reliable telephone
communication link.
Gas deratization is effected by the order of the SQD. Master submit
the request for such operations to the Preventive Disinfection Department.
12.6. Master of the vessel wherein deratization is
performed must ensure guarding and safety of the vessel and fly the
prescribed signals.
12.7. Vessel arriving with food cargo and, also, dangerous
cargo (including radioactive) should inform the SQD of the Port in every
particular case so as to make a decision on their processing and taking
corresponding sanitary measures.
12.8. The Port does not accept the cargoes that are
hazardous from the sanitary viewpoint (raw hides and other products
of animal origin) because of lack of appropriate equipment for its processing.
Reception and dispatch of animals is forbidden.
12.9. In summer time the Port roads and vacant cargo
sites that are used by vehicles should be watered.
12.10. Spoiled goods and materials stored in the Port
warehouses must be immediately carried out of the Port following a conclusion
of the Sanitary & Epidemiological Department.
12.11. Public lavatories should meet sanitary requirements
and must be annually cleaned, washed with water and regular disinfected.
12.12. Warehouse managers are obliged to immediately
inform the Preventive Disinfection Department of the Port on all cases
when pest and insects are detected. It is prohibited to discharge cargo
in warehouses contaminated with pests until they are completely disinfected.
12.13. Carrying out food cargoes and cargoes of animal
origin from the Port territory is allowed with the SQD permission only.
12.14. Owners of buildings and warehouses should keep
clean doors and stairs, corridors and other places of public use at
their own expense.
12.15. Litter bins should be timely cleaned and disinfected.
The territory around the bins should not be blocked with cargoes to
keep accesses to litter bins free.
12.16. Places for collection and short-term storage
of port garbage should be arranged at special sites with improved flooring,
at a distance not closer than 25 m from dining rooms, buffets, industrial
and auxiliary buildings.
12.17. Organizations or persons responsible for a
sanitary condition of institutions, warehouses and other premises must
keep sanitary registers which must be presented to the SQD personnel
at first request to make appropriate entries.
Sanitary control requirements prescribed in the sanitary inspection
conclusions should be fulfilled in prescribed periods.
12.18. All institutions and persons selling food products
in the Port should fulfil sanitary requirements and rules as regards
cleanliness and order where these products are sold, medical certification,
personnel neatness and good quality of products on sale.
12.19. To prevent penetration of rats on board vessels
and from vessels to shore, all mooring lines are to be provided with
rat guards of at least 720 mm diameter for the entire period of vessel's
stay at berth.
At night, if cargo handling is stopped, all ladders and gangways should
be removed or slightly lifted above the berth by at least 1 m and well
illuminated.
12.20. Biological treatment systems of vessels (if
available) should be operated in strict compliance with the instructions
for a particular system. Responsibility for good purification of sewage
when the vessel stays at berth or in the roads rests with the Master.
SQD checks the purification efficiency in the laboratory.

of the vessel is obliged to present all vessel premises for inspection,
produce medical and health certificates of crew members, 1 copy of the
crew list and a certificate on the transfer of garbage and sewage to
Port reception facilities.
The permit for vessel's departure is issued according to a special format,
certified with the round seal and is made, as a rule, on board vessel.
12.22. SQD's permit for departure of the vessel is
valid during 24 hours from the moment of issue and must be submitted
for registration to the ISPS.
Vessels of coastal navigation may receive the permit for a longer term
(though not exceeding 1 month).
12.23. If the cargo is fumigated with phosphine (by
putting phosphine in the cargo), the vessel should leave the Port not
later than 2 hours after fumigation began. The inspection commission
starts its work immediately after loading fumigant in the cargo and
hermetic sealing of holds.
12.24. The Port provides SQD with boats for making
sanitary inspection of vessels staying in the roads, registering arrivals
and implementing antiepidemiological measures on vessels.
12.25. Items: 5.6.4, 5.6.5, 5.6.6, 5.6.7, 5.6.8 of
these CR are also referred to this section.
12.26. Control over fulfilment of sanitary and anti-epidemiological
rules provided by these CR is exercised by the State Sanitary Control.
Violation of these rules entails responsibility according to the Law
of Ukraine "On sanitary and epidemiological safety of population"
dd. 24.02.94, No.4005-XII and "Sanitary Rules for Sea and River
Ports".
13. MEASURES TO PROTECT TRANSPORT AND PORT FLEET
VESSELS IN CASE OF CHEMICAL ALARM (CHLORINE, AMMONIA) IN THE PORT
13.1. The signal "CHEMICAL ALARM" is preceded
by the signal "Attention All" - continuous sounds of sirens,
hooters of enterprises, vessels and other means to attract attention.
Afterwards, the alarm is announced via loudspeakers with addition of
words "chlorine" or "ammonia". The signal is duplicated
by all vessels that stay in the Port.
13.2. When registering arrival of his vessel, the
Master should familiarise himself with the instruction on protection
of crew and persons visiting the vessel from possible poisoning with
virulent substances and take the following measures:
- familiarise all crew members with "Chemical alarm" signal;
- get the Collective Protection Station (CPS) ready and organize
protection of the crew inside the CPS and Port refuges after the
"Chemical alarm" signal is given;
- see that all crew members familiarise themselves with chemical
properties of chlorine and ammonia, location of port refuges and
measures on rendering first aid at poisoning.
13.3. After "Chemical alarm" is announced
in the Port, the measures on protection of crew members and visitors
are fulfilled according to the ship's bill: the Master informs the Port
Manager and the Harbour Master about situation on board using all possible
means of communication.
13.4. The Master of vessel obtains information on
the emergency situation in the Port from the dispatcher-on- duty or
from the Harbour Master.

CUSTOMS RULES OF "ILLICHIVS'K - PORT" CHECKPOINT
Customs Houses control foreign navigation vessels and, also, goods and
other articles carried by these vessels with the purpose to ensure the
established transfer order of goods and other articles through the Customs
border of Ukraine, as well as collect the stipulated dues.
1. CUSTOMS CONTROL OF FOREIGN NAVIGATION VESSELS
1.1. Customs control of ocean-going foreign navigation vessels and goods
and other articles carried by these vessels is effected in the customs
control zones set up at the State Border checkpoints.
1.2. Customs control of vessels arriving from abroad (going abroad)
is executed, as a rule, at berth or, by way of exclusion, in the Port
roads, as agreed with the CCP.
1.3. Customs registration of vessels is carried out round-the-clock,
at once after the arrival. The agent notifies the Customs on the time
of arrival of Ukrainian vessels to the Port 24 hours in advance.
The agent notifies the Customs on the time of arrival of foreign vessels
after receiving messages from the vessels' Masters. Agency companies
should confirm to the Customs the updated time of vessels' arrival to
the Port 2 hours in advance of their expected arrival. Agency companies
notify the Customs on departure of vessels 2 hours before the beginning
of registration of a vessel for a foreign voyage.
1.4. Customs control of vessels arriving abroad (going abroad) is carried
out by commission in structure of representatives of control checkpoint
of Border Forces of Ukraine (CCP), customs, Sanitary and Quarantine
Department and the ship's agent. The Port administration or the ship's
agent ensures delivery of the commission to the vessel and back.
1.5. Tugs, cranes, boats and other floating craft are forbidden to approach
the vessel during customs control.
1.6. When a vessel is departing to a Ukrainian port, the Customs marks
the cargo declaration with stamp "Customs has no objections for
vessel's departure to Ukrainian port". The entry is certified with
the Customs officer personal numbered seal.
1.7. The Customs permit of the urgent departure of a vessel in case
of natural calamity and, also, with the purpose of rescue people and
vessels is not obligatory.
1.8. Foreign navy ships and, also, the ships flying the flag of navy
and Border Forces of Ukraine are not subjected to customs control.
1.9. The persons who arrived on board foreign Navy ships and are not
the members of crew are obliged to pass the customs control at landing
to shore.
1.10. Cargoes and other articles discharged from foreign Navy ships
in customs territory of Ukraine are subjected to customs control.
1.11. Port authorities permit departure of foreign navigation vessels
after all kinds of control on board are completed.
2. CUSTOMS CONTROL DURING VESSEL'S STAY IN PORT
2.1. Port authorities inform customs of beginning and ending of cargo-handling
operations on ship.
The place of vessel's stay during customs registration, discharging
and loading and, also, embarkation and disembarkation of passengers
is specified as agreed with the Customs. The places of discharging and
loading may be changed with the Customs consent except in cases of accident
and natural calamity.
2.2. The persons who are not members of the commission may visit the
vessel after termination of the commission's work only.
2.3. The regime in the customs control zone is established by the
Customs for top-quality execution of customs procedures.
2.4. Before starting the customs registration of foreign navigation
vessels, the Master is obliged to submit the following documents to
the Customs:
- general declaration;
- cargo declaration;
- crew list;
- cargo documents;
- list of passengers;
- customs declaration of the crew members;
- list of ship stocks;
- other documents on demand of the Customs.
2.5. Discharging of imported goods and other articles is carried out
with the permit of the Customs according to the shipping documents.
2.6. Discharge of imported and transit cargo is carried out under bond
only into the Port warehouses and vehicles that are within the bond
zone.
2.7. Removal of imported goods and other articles for free disposal
in the territory of Ukraine or for transit is carried out on the basis
of cargo customs declarations and, also, of the shipping documents that
must bear the stamp "Under Customs bond" imprint of the personal
numbered seal of the Customs' officer..
2.8.When exporting goods and other articles abroad, the forwarding agent
or the owner must present the required documents for these goods and articles
to the Customs prior to loading. As the ship consignment is gradually accumulated,
all earlier submitted to the Customs documents are arranged into the cargo
list and passed over to the Customs for checking. After checking, the lists
are stamped "Loading allowed" and the Customs' officer signs and
certifies his signature with the personal numbered seal.
2.9. In order to prevent import / export of undeclared cargoes, the
Customs checks discharging / loading of foreign navigation vessels according
to the procedure stipulated by the Customs legislation of Ukraine.
2.10. Loading / discharging of technical supplies and food products
for crew meals is carried out after the shipowner presents the customs
cargo declaration confirming payment of customs dues on the basis of
purchase bills.
2.11. Customs control of personal belongings of passengers and crew
members is carried out, as a rule, on board vessel and in the Customs
checking halls, and luggage is checked in the Port warehouses in the
presence of the owner or his authorised person. In individual cases
and by decision of the Customs, the checked belongings may be subjected
to re-check at the Port checkpoints.
2.12. Disembarkation of passengers and crew members from the vessels
that have arrived from abroad is carried out after the Customs and other
kinds of control.
2.13. Embarkation of passengers and replacement crew members on board
vessels that departs abroad is made after customs registration of personal
belongings of such passengers and crew members.

BORDER RULES OF ILLICHIVSK PORT
Border control of foreign and Ukrainian vessels of foreign navigation
is executed at berth or, if necessary, in the roads. In certain cases
border control of passenger vessels arriving from abroad may be effected
in transit while proceeding in the territorial waters (territorial Sea)
of Ukraine before entering the Port. In such instances vessels must
be met by the commission in the agreed point of the territorial waters
(territorial Sea) or internal waters of Ukraine. Border control is executed
within 24 hours after the vessel's arrival, and control of passenger
ships - in accordance with the approved voyage schedule.
An agency company informs "Chornomorya" Border Detachment
on the time of arrival of Ukrainian vessels 24 hours in advance, and
of arrivals of foreign vessels - 12 hours in advance of the estimated
time of arrival. The precise time of arrival should be notified 2 hours
before the vessel enters the Port.
The agency company informs "Chornomorya" Border detachment
on the time of departure of Ukrainian vessels 2 hours before the registration
of the vessel bound abroad begins.
Requests for registration of vessels should be submitted to an officer-on-duty
by phone numbers 42-08; 41-23; 41-21.
An agency company should ensure transportation of the commission to
the vessel for fulfilling their functions and back.
Before proceeding to Border control of the vessel leaving abroad, all
unauthorized persons should leave the vessel, all cargo handling operations
should be completed and all crew members should be on board.
Certain persons may be admitted on board during Border control of foreign
navigation vessels only with the permission of the Chief of "Chornomorya"
Border Detachment.
Port authorities determine the places of stay of foreign vessels and
Ukrainian ships of foreign navigation within ports and in the roads
during Border control, embarkation and disembarkation of passengers
as well as during loading and discharging cargo in co-ordination with
"Chornomorya" Border Detachment and the Customs.
Foreign vessels are prohibited to change their mooring places in the
port and in the roads, as well as to disembark and embark passengers
and load / discharge cargoes without the permit of Port authorities
and "Chornomorya" Border Detachment, except at accidents and
natural calamities. Tugs, cranes, boats and other crafts may not approach
foreign vessels during their stay in the port and in the roads without
authorization of "Chornomorya" Border Detachment.
Representatives of enterprises, institutions, organizations and port
personnel attending foreign ships vessels staying at port berths may
be admitted on board if they have passes issued by the CCP of Border
Forces of Ukraine and ID cards. Stevedores may be admitted on board
foreign vessels only if they are members of the working team that has
an order to fulfil works on board this vessel.
Passes are issued by "Chornomorya" Border Detachment in accordance
with the written requests of managers of concerned enterprises, institutions
and organizations for a period of up to 1 year. If necessary, it is
possible to obtain a pass for a single visit. Passes should be returned
after their term expires.
Managers of shipping companies, the port, Customs House, maritime agencies,
the Harbour Master and their deputies may visit foreign ships staying
in ports any time without the passes of Border Detachment using their
official ID cards.
Members of the commission checking Ukrainian and foreign vessels of
foreign navigation visit vessels together with a chief officer of Border
detail.
Crew members, entered in the crew list, who possess valid seaman's passports
or ID cards may land with the passes certifying their right to stay
ashore at any time of the day without the passes of Border detachment
on the basis of their Ids or seaman's passports.
Landing passes give crew members the right to stay in the port town
during 24 hours whereof they should be informed by the Captain of the
vessel.
"Chornomorya" Border detachment prohibits crew members of
foreign ships and other persons on board these vessels, as well as persons
prohibited to enter Ukraine, to land and stay ashore if they have committed
infringement during navigation or staying in the territorial waters
(territorial Sea) and internal waters of Ukraine, during ship's stay
in Ukrainian ports. All cases of infringement committed by foreign sailors,
as well as violation of navigation regime of foreign vessels in ports,
should be declared by Border detachment to shipping agencies in writing
for taking corresponding measures.
"Chornomorya" Border detachment, together with Security Service
of Ukraine and Ministry of Foreign Affairs, Port authorities and agencies,
takes necessary measures against crew members of foreign ships who have
committed infringements, provocative and other wrongful actions with
respect of the Border details, in accordance with the legislation of
Ukraine.
Crew members of foreign flag vessels may visit other foreign vessels
staying in the port with a permission of the Chief of "Chornomorya"
Border Detachment or his deputies that is issued on a case by case basis.
The person going on board such vessel should leave his pass with the
Border detail.
Foreign sailor relatives may visit foreign seamen on board in accordance
with the same procedure and with the same documents they entered and
stay in Ukraine.
Masters may visit vessels of the other countries with their ID cards
and seaman's passport.
Foreign citizens and persons without citizenship who have arrived to
the port on board foreign vessels with expired documents or without
prescribed documents that allow of entering Ukraine, are prohibited
to land. In certain cases the time and landing may be allowed to such
persons by the Chief of "Chornomorya" Border Detachment.
By request of the Master, the Chief of Border detachment may allow individual
foreign crew seamen to leave Ukraine with their seamen's passport or
ID cards by other ships sailing from the same port. Foreign seamen leaving
Ukraine by casual vessels or by other transport should have exit visas
whereof the agency companies should notify in writing one day before
the departure. The same procedure is used to replace crew of foreign
vessels staying in the port or in the roads.
In accordance with the Law "On the State Border of Ukraine",
Masters of Ukrainian vessels proceeding abroad, are personally responsible
for illegal presence on board of persons who are neither crew members
nor passengers. They must take measures to avoid penetration of stowaways
on board vessels proceeding abroad.
Watches of Ukrainian flag vessels of foreign navigation check visits
paid by persons who are not crew members of such vessels. A watchman
admits such persons on board with the permission of the watch officer
checking the identification documents and leaving them with the watch
until such persons leave the vessel.
So as to prevent strangers leaving Ukraine illegally on board Ukrainian
vessels, the Master is obliged to organize a thorough examination of
all ship's compartments by the force of the crew members. A vessel may
sail on the voyage after she has been inspected, if the Master is personally
sure that there are no strangers on board.
The Master should appoint individual crew members to be responsible
for the examination of particular vessel's compartments. The examination
should be obligatory performed in the following instances:
- just before the vessel leaves a Ukrainian port for foreign voyage
and before this vessel arrives to a foreign port;
- before the vessel leaves the last foreign port of call for proceeding
to a Ukrainian port and before arrival to a Ukrainian port.
If necessary, an additional examination of the vessel by the Border
detail should be effected together with the crew.
Upon receiving an information about stowaways on board Ukrainian ships
of foreign navigation that leave the port, the Border detachment's officer
on duty transmits the call-signal "Desna" on VHF. After receiving
such signal the Master must perform a repeated examination of the vessel
and inform Port authorities on its result.
Staying of private craft in the regime area of port waters is prohibited.
Border control of foreign and Ukrainian vessels proceeding to another
Ukrainian port is executed according to the procedure for coastal navigation
vessels. The permit for their departure from the port is registered
by the Border detail of "Chornomorya" Detachment. Agency companies
inform the Border detachment about the departure time at least 2 hours
before the estimated time of the vessel's departure.
